BookMart is a book resale and donation platform based in Tripura, India, operating under the domain thebookmart.in. We facilitate the buying, selling, and donation of new and pre-loved school and academic books between individuals and our platform.

In these Terms, "BookMart", "we", "us", or "our" refers to the BookMart team. "You", "user", or "customer" refers to anyone who visits our website or uses our services.

Acceptance of Terms

By visiting thebookmart.in, submitting a form, contacting us via WhatsApp, phone, or email, or engaging in any transaction with BookMart, you agree to these Terms & Conditions in full.

If you are using our services on behalf of a minor (such as a child's school books), you represent that you are the parent or legal guardian and accept these terms on their behalf.

We reserve the right to modify these terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.

All services are subject to availability. We reserve the right to refuse service to any individual at our sole discretion.

Buying Books

When purchasing books from BookMart, the following terms apply:

• Condition descriptions — Books are described as accurately as possible. Pre-loved books may show normal signs of use. Photographs or specific condition reports may be requested before purchase.
• Pricing — Prices listed on our website or shared via WhatsApp are final at the time of confirmation. Prices are subject to change without notice until an order is confirmed.
• Order confirmation — A purchase is confirmed only when we explicitly confirm it via WhatsApp or email. Browsing our catalogue does not constitute a purchase commitment.
• Delivery — Delivery timelines will be communicated at the time of purchase. We are not liable for delays caused by circumstances outside our control.
• Returns & refunds — If a book is significantly different from its described condition, please contact us within 48 hours of receipt. We will assess each case individually and offer an appropriate resolution, which may include exchange or refund.
• Availability — All book listings are subject to prior sale. We will notify you promptly if a listed book becomes unavailable after your enquiry.

Selling Books

When submitting a sell listing through BookMart, you agree to the following:

• Accurate information — You must provide truthful and accurate details about the books you are selling, including their condition, quantity, and any relevant details. Misrepresentation may result in a revised or withdrawn offer.
• Ownership — By submitting a listing, you confirm that you are the rightful owner of the books and have the legal right to sell them.
• Price offer — After reviewing your listing, our team will contact you via WhatsApp with a price offer within 24 hours. This offer is not binding until accepted by both parties.
• Pickup — If you accept our offer, we will arrange a doorstep pickup at a mutually convenient time. You are responsible for having the books ready and accessible at the agreed time.
• Payment — Payment for accepted books will be made via the method agreed upon at the time of the transaction (cash on pickup or UPI transfer). We do not make advance payments.
• Rejection — We reserve the right to decline, revise, or withdraw an offer if the books do not match the listing description upon inspection.
• No obligation — Submitting a listing does not obligate you to sell. You may withdraw your listing at any time before the pickup is arranged.

Donations

BookMart accepts book donations to redistribute to students in need.

• Voluntary — All donations are entirely voluntary and no compensation is provided for donated books.
• Condition — We request that donated books be in a usable condition — readable, with no missing pages. We reserve the right to decline books that are severely damaged or unusable.
• Usage — Donated books will be distributed to students or used to support our affordable pricing model. BookMart has full discretion over how donated books are used.
• Tax receipts — We currently do not issue formal tax donation receipts. If required, please contact us in advance.

Pricing & Payments

All prices displayed on our website are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.

• Prices are subject to change without prior notice. The price confirmed at the time of your order is the final price for that transaction.
• We accept cash on delivery and UPI payments. Accepted payment methods will be confirmed at the time of your order.
• We do not store any payment card or banking information. All financial transactions are handled directly and securely.
• In the event of a pricing error on our website, we reserve the right to cancel an order and notify you accordingly.

User Conduct

By using our website and services, you agree not to:

• Provide false, misleading, or fraudulent information in any form or communication.
• Attempt to hack, scrape, overload, or interfere with the operation of our website.
• Use our contact channels to send spam, abuse, or unsolicited messages.
• Misrepresent your identity or impersonate any person or entity.
• Use our services for any unlawful purpose or in violation of any applicable Indian law.

Violation of these terms may result in immediate refusal of service and, where appropriate, reporting to relevant authorities.

Intellectual Property

All content on thebookmart.in — including but not limited to the BookMart name, logo, website design, text, graphics, and code — is the property of BookMart and is protected under applicable Indian intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
• You may share links to our website freely.
• Book titles, authors, publishers, and ISBN numbers referenced on our platform remain the property of their respective rights holders. We do not claim ownership over these.

Disclaimers & Limitation of Liability

To the fullest extent permitted by law:

• BookMart does not warrant that the website will be uninterrupted, error-free, or free of viruses or harmful components.
• We are not liable for any loss or damage arising from your use of our website, reliance on information on our website, or any transaction conducted through our services.
• We are not responsible for delays, failures, or issues caused by circumstances beyond our reasonable control, including but not limited to natural disasters, network outages, courier delays, or government actions.
• Our total liability for any claim arising from or related to our services shall not exceed the amount you paid for the specific transaction giving rise to the claim.

Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, where such exclusion is prohibited by Indian law.

• We use Google Workspace (Apps Script, Sheets, Gmail) for form processing. Your use of our forms is subject to Google's terms in addition to ours.

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the state of Tripura.

Any disputes arising out of or in connection with these terms or our services shall first be attempted to be resolved amicably through direct communication. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the competent courts in Tripura, India.
